I’ve written many times on my blog about the numerous drugs which have run out of stock. In many cases this is due to them going generic and the manufacturers don’t think it’s cost effective to make them and sell them at a new lower price. People are dying because of this, and others are taking advantage of those in need, finding a supply and buying them up and reselling them to pharmacies and hospitals at huge mark ups as high as 80x the normal retail price. A recent survey found that small wholesalers typically increased prices by 650% during drug shortages. The New York Times reported that President Obama will issue an executive order today offering drug manufacturers and wholesalers solutions. It will instruct the Food & Drug Administration (FDA) to do three things : broaden reporting of potential shortages of certain prescription drugs; speed reviews of applications to begin or alter production of these drugs; and provide more information to the Justice Department about possible instances of collusion or price gouging. The order comes because a bill doing the same thing has been stuck in Congress since February despite bipartisan support. It seems incomprehensible that Congress has been unable to move the legislation through and forced President Obama to make the first Executive Order affecting the functioning of the FDA since 1985. The FDA regulates products incorporating 25% of every dollar we spend and must get this issue resolved before hundreds or even thousands of more people die. “The president’s action is a recognition of the fact that this is a serious problem, and we can and should do more to help solve it,” said an administration official. “We can’t wait anymore.” There are 180 drugs critical for treating cancer, leukemia, infections and other diseases that are in short supply, an all time record. The Obama administration also plans to send letters to manufacturers reminding them of their legal obligation to report pending supply disruptions of certain drugs and also encourages them to notify the FDA of events which could lead to disruption in the supply change even if they aren’t required to do so by law. I am glad to see the President stepping in with this executive order but extremely frustrated that our Congress moves so slowly on important issues like this.
